Welcome to Breakout Bras ("we," "us," "our"). These Terms and Conditions ("Terms") govern your access to and use of our website breakoutbras.com (the "Site"), our mobile applications (if any), and any services we provide, including the purchase of products (collectively, the "Services").

By accessing or using the Site or Services, or by placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase from us.

We may update these Terms from time to time. The updated version will be posted here with a revised "Last Updated" date. Your continued use after changes constitutes acceptance of the revised Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or make purchases. By using the Site, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

2. Account Registration

Some features may require creating an account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3. Products and Orders

• All products are subject to availability. We reserve the right to limit quantities, discontinue items, or cancel orders (including after confirmation) due to pricing errors, stock issues, or other reasons. If we cancel, we will refund any amounts paid.
• Descriptions, images, sizing information, and pricing are provided for convenience and may contain errors. We do not warrant that product information is accurate, complete, or current.
• Prices are in U.S. dollars and exclude taxes and shipping unless stated otherwise. Taxes and shipping will be added at checkout.
• We specialize in a wide range of bra sizes (AA–T cups, 26–56 bands) and intimate apparel from various brands. Due to the personal nature of many items (e.g., bras, panties, swimwear), certain products may be non-returnable except for defects—see our Returns/Exchanges policy for details.

4. Payment

We accept major credit cards and other payment methods displayed at checkout. By providing payment information, you authorize us (and our third-party processors) to charge the total amount, including taxes and shipping. You represent that you are authorized to use the payment method.

5. Shipping and Delivery

• Shipping terms, rates, and estimated delivery times are provided at checkout and in our Shipping Policy (if separate).
• Risk of loss passes to you upon delivery to the carrier. Title passes upon full payment.
• We are not responsible for delays caused by carriers, customs (for international orders), or events beyond our control.

6. Returns and Exchanges

Please refer to our separate Returns/Exchanges Policy (or wherever posted) for details on returns, exchanges, refunds, time limits, conditions, and any exceptions (e.g., final sale items, hygiene-sealed products, sale/clearance items). Many intimate apparel items are non-returnable for hygiene reasons unless defective.

7. Intellectual Property

The Site, including text, graphics, logos, images, product photos, and software, is owned by us or our licensors and protected by U.S. and international copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part without our prior written consent.

8. User Content

If you submit reviews, photos, comments, or other content ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display it in any media. You represent that your User Content does not infringe third-party rights and is not unlawful.

We may remove or refuse to post any User Content at our discretion.

9. Prohibited Conduct

You agree not to:

• Use the Site for unlawful purposes or in violation of these Terms;
• Attempt to gain unauthorized access or interfere with the Site;
• Transmit viruses, malware, or harmful code;
• Harass, impersonate, or mislead others;
• Scrape, crawl, or data-mine the Site without permission.

10. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS.

Sizing and fit are subjective; we provide guidance but cannot guarantee perfect fit for every individual.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BREAKOUT BRAS, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so these may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or infringement of third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Greenville County, South Carolina. You consent to the personal jurisdiction of such courts.

14. Miscellaneous

• If any provision is held invalid, the remainder remains in effect.
• Our failure to enforce any right does not waive it.
• These Terms constitute the entire agreement between you and us regarding the Site and purchases (superseding prior agreements).
• We may assign these Terms; you may not without our consent.
